Are My Overseas Debts Included in My Bankruptcy?

Yes, if you have debts that were incurred overseas you should definitely include those debts on your bankruptcy form, for the liabilities to be included in your Australian bankruptcy. This will protect you from those creditors whilst ever you are in Australia. However, if you subsequently return to the country where the debt was created, you could be subject to debt recovery proceedings in that country. You should obtain legal advice on this from a Solicitor who has knowledge on the laws in that country, before returning.
